The Iowa Alcoholic Beverages Division holds both contested case and
appeal administrative hearings at the Divisions office located
at 1918 SE Hulsizer Road in Ankeny, Iowa. Contested case hearings
are held when alleged violations to Iowas alcoholic beverages
laws are committed by a licensee, or a licensees employee or
agent. The hearings are initiated as a result of investigations conducted
by law enforcement officials. Licensees charged with violations of
Iowa Code chapter 123 or the Divisions administrative rules
are given the opportunity to contest the allegation by requesting
a formal hearing to present evidence and testimony regarding the alleged
violation or negotiating a settlement through a stipulated agreement.
Appeal hearings are held as a result of local authority actions ranging
from the imposition of civil penalties, license suspension or revocation
to the denial of new and renewal licenses or permits. Licensees who
have had an administrative penalty imposed against the alcoholic beverages
license or have had the license application denied by a local authority
may appeal to the Division by requesting an appeal hearing to present
evidence and testimony regarding the violation or denied application.
Local authority action may be reversed, affirmed or modified through
the appeal hearing process. |
