ALJ Proposed Decisions

Administrative action by the Iowa Alcoholic Beverages Division may occur through contested case hearings, where a case is heard at the Division’s offices by an administrative law judge from the Iowa Department of Inspections and Appeals. A proposed decision will be issued following the hearing to impose civil penalty, suspend or revoke the license or dismiss all or part of the allegations cited. The Division also hears appeal hearings in which licensees appeal local authority actions (civil penalties, license suspensions or revocations or denied license applications).

Following the hearing, the administrative law judge issues a proposed decision. The proposed decision will be in writing and will be forwarded to all interested parties by mail. The proposed decision becomes a final decision unless a request for review is filed with the Division administrator within 30 days from the party’s receipt of the proposed decision. The prosecuting attorney (assistant attorney general, county or city attorney) also may request review of the proposed decision.

The Division administrator then reviews the proposed decision on the record made at the hearing and on briefs and exceptions filed by the licensee and the prosecuting attorney. When review of the record is complete, the administrator issues a final decision. The administrator’s decision is final agency action, the next step in the appeal process is to the district court.
